What changed federally in April 2026
A Department of Justice order effective 23 April 2026 moved state-legal medical cannabis and FDA-approved cannabis drug products from Schedule I to Schedule III. Three related actions were published in the Federal Register on 28 April 2026.
Adult-use recreational cannabis was not included and remained Schedule I federally. Broader rescheduling stayed under administrative review, with an expedited hearing scheduled and litigation filed by opponents.
Practical consequences of the federal/state gap persist regardless — banking, employment drug testing, firearms purchase, federal housing, immigration, and crossing state or national borders.
